1. General

Sellboard is a classifieds marketplace where users post and browse listings, message each other, and — for service listings — make bookings. The service is operated by Smart Software registered at Gorczyn 64B, 98-100 Łask. The operator acts solely as an intermediary providing the platform and is not a party to any transaction between users. By using the service you accept these Terms.

2. User accounts

Only people aged 18 or over may use the service. By registering, you confirm that the information you provide is accurate and up to date. You can create an account with an e-mail address and password (the e-mail address must be confirmed with a verification code sent by e-mail), or by signing in with Google or Facebook. You are responsible for keeping your login credentials confidential and for all activity on your account.

3. Posting rules

When you post a listing, you represent that it is truthful, accurate, and that you have the right to offer the item or service described. It is prohibited to post listings for unlawful or banned goods or services, misleading, fraudulent, or scam content, or content that infringes the intellectual property rights of third parties. The operator is not a party to transactions between users and is not responsible for the quality, legality, or accuracy of any item or service offered.

4. Prohibited content, reporting, and moderation

Sellboard has zero tolerance for objectionable content and abusive users. Content that breaks these rules is removed, and the accounts responsible are suspended or removed.

In addition to the rules in Section 3, it is prohibited to post abusive content, content that violates the personal rights of others, content inciting violence or hatred, and spam. Any listing or message can be reported for moderation. We reserve the right to remove content that violates these Terms or the law. Where violations occur, a user's account may be suspended; suspension is reversible and may be lifted once the matter is resolved or the violation is remedied. We review reports of listings and users promptly, as a rule within 24 hours. Any user can also block another user (from their profile or a conversation): blocked users cannot message them or send them booking requests, and their listings are no longer shown to the blocker; a block can be lifted at any time in the account settings.

5. Intellectual property

You retain ownership of the content you post (such as listing descriptions and photos) and grant the operator a non-exclusive licence to store, process (including automatic image conversion), and display that content within the service to the extent needed to operate it. The Sellboard name, logo, software, and visual design are the property of the operator and may not be used without permission.

6. Liability

The operator provides a platform that lets users contact each other and is not a party to transactions between them; accordingly, the operator is not liable for users' conduct, the content of listings, the quality of any item or service offered, or the performance of agreements between users. The service is provided "as is", without additional warranties. The operator's liability is limited to the extent permitted by Polish law.

7. Promotions

Promotions, discounts and other special offers on bookable services are the offer of the business that creates them. The business is responsible for honouring a promotion on the terms it states, and for the accuracy of the prices and conditions it gives, including limits on places and on visit dates. The service only displays them and is not a party to the sale or to the performance of the service. A booking made with a promotion keeps its price, even if the promotion later ends or is changed.

8. Changes to these terms

We may amend these Terms from time to time, in particular to reflect changes in the law or in the service's functionality. We will notify users of material changes in advance, via a notice within the service or by e-mail. Continued use of the service after changes take effect constitutes acceptance of them.

9. Governing law and disputes

These Terms are governed by Polish law. Any dispute will be resolved by the competent Polish courts. Consumers may also use the EU Online Dispute Resolution (ODR) platform, available at https://ec.europa.eu/consumers/odr.

Some Sellboard plans (for example Pro) are paid. Prices are shown net, per month; value added tax (VAT) or its local equivalent is added at checkout according to the rules of the buyer's country and is shown before the payment is confirmed.

Payments are handled by Stripe (Managed Payments / Link). Stripe is the seller of the subscription to the buyer (merchant of record): it takes the payment, handles the taxes and issues the buyer's sales document. We do not store your card details.

A subscription renews automatically every month until it is cancelled. The owner of the business cancels at any time on the business's plan page by choosing the free plan ("Switch to Free") - also when the last payment failed; a cancellation takes effect at the end of the period already paid for, and the plan stays active until then. "Manage subscription" is for changing the card and viewing invoices. If a payment fails, Stripe retries it for a while and the plan stays active, but at most 14 days after the end of the period already paid for; if it still fails, the subscription ends and the business returns to the free plan. The plan can be changed on the plan page: a higher plan starts at once (with a proportional charge for the rest of the period), a lower plan at the end of the current period. A business has one subscription at a time; a second one bought by mistake is cancelled and its payment refunded in full.

Deleting an account or a business ends its subscription: when an account is deleted, at once and without a refund of the unused part of the period; when a business is deleted, at the end of the period already paid for.

We announce a change of a plan's price to the owners at least 30 days in advance (by e-mail and in the service); the new price applies from the first renewal after the stated date, and the current price applies until then. A price decrease may apply from the next renewal. We do not move a subscription if the e-mail announcing the change could not be sent to the owner, or if the owner has scheduled a lower plan or a cancellation of their own. You can cancel before that date by choosing the free plan ("Switch to Free") on the business's plan page.

Taking a plan off sale does not change the terms of existing subscribers. If a plan is retired, we notify the owners at least 30 days in advance and either move the subscription to the plan we name from the first renewal after that date, or end it at the end of the period, after which the business is on the free plan. You can cancel before that date.

Amounts paid for a month already started are not refunded for the unused part of the period, except where the law provides otherwise.
